Large Law Firm Experience
As an associate and partner in large law firms Don gained
experience handling major, complex litigation, including serving as trial
counsel in one of the largest criminal anti-trust cases to go to trial; lead
counsel in a $300,000,000 False Claims Act trial in the Bicoastal bankruptcy;
civil fraud litigation that resulted in the first criminal convictions in
Florida of S&L officers during the savings and loan crisis; other
anti-trust, securities and commercial disputes. Don has the background to
effectively handle major matters and deal with major law firms.
Small Law Firm Experience
Don formed the Jernberg Law Group in 2002 after ending his
joint venture with Ernst and Young. Don uses the independence gained by not
being a member of a large firm to offer clients efficient, quality legal
representation with flexible fees and engagement terms. In appropriate cases,
the firm will handle matters on a contingent fee basis or accept equity as part
of the compensation, both of which align the firm’s interests closely with
those of the client. When hourly fees are charged, a low overhead structure
allows hourly rates that are equal to what major firms charge for relatively
inexperienced attorneys.
In-House Experience
Don served as outside general counsel to a large insurance
industry reinsurance pool from 1990 to 1999. He functioned as the equivalent of
inside general counsel, dealing regularly with management and the Board of
Directors, overseeing outside counsel and claim managers, and assisting in
forming corporate policy and strategies. He was asked by the Board to assume
overall management responsibility as the association sought to cease operation
by arranging to transfer nearly $40,000,000 in liabilities, which he
successfully arranged and negotiated. This experience helped Don better
appreciate the challenges face by inside counsel in managing costs and
balancing the legal, risk management and business interests of the client.
Alan Case served 8 years in Motorola’s legal department
where he provided general commercial legal advice for several divisions of the
company. He was responsible for developing corporate-wide policies regarding
product safety, and reduction of contractual damage exposure for the company.
he can assist companies of any size with effectively handling a broad range of
their legal needs.
Business Experience
In 1999, Don was asked by Ernst and Young to form and
operate a joint venture focused on dispute resolution processes and
technologies. This provided direct experience with the challenges faced by
start-up and early stage companies. In managing the joint venture, Don oversaw
the design and development of three software programs. He holds a patent on one
of the programs. Since returning to
practice in 2002, Don has worked with a number of entrepreneurs, providing both
a range of legal services and strategic and practical business counseling.
Working with a number of early stage companies provides Don with a broad
perspective on common challenges and potential solutions.
At Motorola, Alan moved from the law department into a
business function at the Smart Card Solutions Division. He was responsible
identifying, negotiating and implementing strategic alliances on a global
basis. He also was responsible from a business perspective, as well as legal,
for various contracts and licensing agreements for the Division.
In providing legal representation to companies, Don and Alan
strive to understand the practical and strategic business considerations which
may be implicated by any legal position. The goal is to provide business
clients with actionable advice on which they can rely in making business
decisions.
