Don has represented both large corporations and individuals in a wide range of civil litigation. Direct insurance defense experience includes asbestos litigation (Madison County, Illinois), toxic torts, environmental, products liability, construction defects and professional liability. General litigation experience includes contracts, personal guarantees, mechanics liens, anti-trust, securities, employment disputes and general commercial matters. Experience includes trial counsel in successful defense in one of the largest criminal anti-trust case ever brought to trial; lead counsel in successful defense of $300,000,000 False Claim Act case in Bicoastal bankruptcy; lead counsel in securities litigation that resulted in first criminal convictions of savings and loan officers in Florida during S&L crisis in 1980s.
As general counsel to an insurance pool, Don had responsibility for the management of a portfolio of litigation handled by different lawyers in different states. This experience highlighted the difference between litigation efficiently handled that needed to proceed and litigation that was either not productive or was being handled inefficiently. In his first year as general counsel, Don reduced outside legal fees by over $1,000,000 and got 60% of the cases resolved and closed. Don brings this same client oriented approach to all litigation, focusing on what is necessary to vigorously represent the client while avoiding unnecessary and expensive litigation gamesmanship.
